2. Response to Takedown Notices
Upon receiving a valid DMCA notice, we will:
- Promptly remove or disable access to the allegedly infringing material
- Notify the user responsible for the content
- Provide them with information on how to file a counter-notification (if applicable)
3. Counter-Notification
If you believe that the content removed or disabled as a result of a DMCA notice was removed in error or misidentification, you may submit a written counter-notification to our designated agent including:
- Your name, address, telephone number, and email address
- The exact URL of the content that was removed or disabled
- A statement under penalty of perjury that you have a good faith belief the content was removed or disabled as a result of mistake or misidentification
- A statement that you consent to the jurisdiction of the courts in the United Kingdom and will accept service of process from the person who provided the DMCA notice
- Your physical or electronic signature
Upon receiving a valid counter-notification, we may restore the removed material after 10 business days, unless the original complainant notifies us that they have filed a court action against the content provider.
4. Repeat Infringers
ForgottenPlaces.org.uk reserves the right to terminate access to users who are repeat infringers of intellectual property rights.
